These terms govern the use of phycoferm.com, explain how we use cookies, and set out how we handle personal data. They cover the website only. Supply of ingredients, licensing of strains and processes, and development services are governed by separate written agreements.

1. Who we are
This website is operated by PhycoFerm, Lda., a private limited company (sociedade por quotas) registered in Portugal under tax identification number (NIPC) 518 077 667, trading under the commercial designation PhycoFerm Nutrition.

In these terms, “we”, “us” and “PhycoFerm” mean PhycoFerm, Lda. “You” means any person accessing or using this website.
2. Scope and acceptance
These terms and conditions govern your access to and use of phycoferm.com and any content, functionality or services offered on or through it. By using this website you accept these terms in full. If you do not accept them, please do not use the website.
These terms apply to use of the website only. Any supply of ingredients, licensing of strains or processes, or provision of development services is governed by a separate written agreement between you and PhycoFerm. Nothing on this website forms part of such an agreement, and where a signed agreement conflicts with these terms, the signed agreement prevails in respect of that supply.
3. Permitted use of the website
You may use this website for lawful purposes connected with evaluating, discussing or managing a commercial or research relationship with PhycoFerm.
You agree not to:
- use the website in any way that breaches applicable law or regulation;
- attempt to gain unauthorised access to the website, the server on which it is stored, or any connected system;
- introduce malware, or otherwise interfere with the proper working of the website;
- use automated systems to scrape, harvest or systematically extract content, other than search engine crawlers acting in accordance with our robots directives;
- reproduce, republish or exploit our content commercially without our prior written consent.
We may suspend or restrict access to the website at any time, without notice, where we consider it necessary.
4. Intellectual property
Unless stated otherwise, all content on this website, including text, images, photographs, graphics, layout, page design and the PhycoFerm name and logo, is owned by PhycoFerm or licensed to us, and is protected by copyright, trade mark and other intellectual property law.
You may view, download and print pages from this website for your own internal evaluation purposes. You may not otherwise copy, adapt, distribute or publish our content without our prior written consent. Our strains, fermentation processes, know-how and related technical material are proprietary and are not licensed by your use of this website.
Third-party logos, project marks and funding acknowledgements shown on this website remain the property of their respective owners and appear with permission or as required by the relevant funding programme.
5. Information on this website
The website describes our technology platform, capabilities and projects for general information. Technical figures, performance ranges, development stages and timelines are indicative and reflect our position at the time of publication. They are not specifications, guarantees or warranties, and they must not be relied upon as such.
Nothing on this website is an offer to sell, licence or supply anything, and nothing constitutes technical, regulatory, nutritional, medical, investment or legal advice. Where regulatory status is mentioned, it is our current understanding and it remains the responsibility of the party placing a product on the market to satisfy itself of the applicable requirements.
We take reasonable care to keep the website accurate and up to date, but we do not warrant that it is complete, current or error free.
6. Enquiries and communications
Where you send us an enquiry through a form on this website or by email, you are responsible for the accuracy of the information you provide, and for having the authority to share it.
Please do not send confidential or commercially sensitive information through the website or by unencrypted email. Where a discussion requires confidentiality, we will put a non-disclosure agreement in place first. Information sent to us before an NDA is executed is not treated as confidential, although we will handle personal data in accordance with section 10 below.
7. Third-party links
This website may link to third-party websites, including those of research partners, funding programmes and social media platforms. Those links are provided for convenience. We do not control those websites, we do not endorse their content, and we accept no responsibility for them or for any loss arising from your use of them. Their own terms and privacy policies apply.
8. Limitation of liability
To the fullest extent permitted by law, we exclude all implied conditions, warranties and representations relating to this website and its content.
We will not be liable for any loss of profit, loss of business, loss of anticipated savings, loss of data, or any indirect or consequential loss arising out of or in connection with your use of, or inability to use, this website, or your reliance on any content on it.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.

A cookie is a small text file placed on your device when you visit a website. Similar technologies, such as browser local storage and pixels, work in comparable ways. We refer to all of them as cookies below.

Managing cookies
Where consent is required, we set non-essential cookies only after you give it, and you can withdraw or change your choice at any time. You can also block or delete cookies through your browser settings. Blocking strictly necessary cookies may stop parts of the website working.
Some cookies are set by third parties whose services we use to host, secure and operate the website. Those providers act as our processors or, where they determine their own purposes, as separate controllers under their own policies.
10. Data protection and processing
PhycoFerm, Lda. is the controller of personal data collected through this website, within the meaning of the General Data Protection Regulation (EU) 2016/679 (GDPR) and Portuguese Law 58/2019.

Who we share it with
We share personal data only where necessary, with: our website hosting, security and email providers acting as processors under contract; professional advisers where required; and public authorities where we are legally obliged to do so. We do not sell personal data and we do not share it for advertising.
Where a provider processes data outside the European Economic Area, we rely on an adequacy decision or on the European Commission Standard Contractual Clauses together with any additional measures required.
How long we keep it
Enquiry correspondence is kept for up to two years after our last contact, unless a commercial relationship begins, in which case it is kept for the life of that relationship and for the statutory retention period afterwards. Job applications are kept for up to twelve months unless you ask us to remove them sooner. Server and security logs are kept for up to twelve months. Analytics data is kept in aggregated form.
Your rights
Subject to the conditions in the GDPR, you have the right to request access to your personal data, and its rectification or erasure; to request restriction of processing or to object to it; to data portability; and to withdraw consent at any time where processing is based on consent. Withdrawing consent does not affect processing carried out before withdrawal.

Providing personal data through this website is voluntary. If you choose not to provide the information requested in a form, we may be unable to respond to your enquiry.
11. Security
We apply appropriate technical and organisational measures to protect personal data, including encrypted transport (HTTPS), access controls, hosting-level security and monitoring, and restriction of access to those who need it. No transmission over the internet can be guaranteed completely secure, and you send information to us at your own risk.
12. Changes to these terms
We may update these terms from time to time to reflect changes in our practices, our services or the law. The version published on this page is the version in force, and the date it was last updated is shown at the top. Where a change materially affects how we handle personal data, we will take reasonable steps to bring it to your attention.
13. Governing law and jurisdiction
These terms, and any dispute arising out of or in connection with them or with your use of this website, are governed by Portuguese law. The courts of Faro, Portugal, have exclusive jurisdiction, save that where you are a consumer resident in another EU member state you retain the protection of the mandatory provisions and the courts of your country of residence.
